1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your use of the Florida Construction Estimating Services website and the construction estimating, quantity takeoff and related consulting services we provide (“Services”). By using our website, approving a quote or accepting delivery of an estimate, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.

2. Our Services

We provide construction cost estimates, quantity and material takeoffs, bid preparation and leveling, value engineering, change order pricing, Xactimate insurance estimates and related services, as described on our website and in each project quote. The specific scope, deliverables, fee and delivery date for each project are set out in the quote or proposal you approve. 3. Quotes, Fees & Payment

• Quotes are free and are based on the documents and scope you provide. If the documents or scope change, the fee and delivery date may change.
• Unless your quote says otherwise, payment is due before work begins or upon delivery, as stated in the quote.
• Fees are for the Services described. Extra work, such as major redesigns, added trades or additional revisions beyond the quoted scope, may be billed separately after you approve it.
• Late payments may delay delivery of current and future work.

4. Client Responsibilities

• Provide complete, legible and current drawings, specifications, addenda and project information.
• Tell us the project location, bid date, required scope and any special pricing instructions.
• Confirm you have the right to share the documents you send us.
• Review the estimate, including assumptions, inclusions and exclusions, before relying on it or submitting a bid.

5. Nature of Estimates & No Guarantee

Important: A construction estimate is a professional opinion of probable cost, prepared from the information available when it is prepared. It is not a guarantee of actual construction cost, bid results, contract award, insurance claim payment or project profitability.

• Actual costs may vary because of market conditions, material and labor availability, subcontractor pricing, design changes, site conditions, weather, storm events, code interpretations, schedule and other factors outside our control.
• Estimate accuracy depends on how complete the design documents are, as reflected in the estimate class we state.
• You remain responsible for the final bid price, contract terms, contingency, means and methods, and all business decisions based on the estimate.
• Our Services do not include engineering, architectural design, code compliance certification, permitting, legal, insurance-adjusting or accounting advice.

6. Revisions

Each quote states the revisions included. Minor corrections for errors on our part are made at no charge. Revisions for addenda, design changes or scope changes are handled as described in your quote, or as extra work once you approve it.

7. Confidentiality

We keep your project documents, pricing and bid information confidential and use them only to perform the Services. You agree to keep our estimating templates, methods and non-public pricing data confidential. Either party may disclose information when required by law.

8. Intellectual Property & License

When you have paid in full, you may use the delivered estimate and takeoff for your own project and business purposes, including submitting bids and sharing them with owners, lenders and insurers for that project. We keep ownership of our templates, methods, software outputs and all website content, including text, graphics, logos and design. You may not copy, resell or republish our website content or deliverables as your own estimating product without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms is limited to the fees you paid for the specific Services that gave rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost bids, lost contracts, cost overruns or business interruption, even if we were told such damages were possible.

10. Indemnification

You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable attorneys’ fees, arising from your use of the deliverables, your bids or contracts, your violation of these Terms, or documents you provided without the right to share them.

11. Website Use

Website content is for general information only and may change without notice. You agree not to misuse the website, including attempting unauthorized access, uploading malicious files, or scraping content for commercial use. Links to third-party sites are provided for convenience only, and we are not responsible for their content.

12. Cancellation

You may cancel a project before work begins for a refund of any prepaid fee. If you cancel after work has started, fees are charged for the work completed up to the cancellation date. We may decline or stop work if payment terms are not met, or if documents are incomplete or were provided without authorization.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and both parties consent to jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on this page, with its “Last updated” date, applies to Services quoted after that date.
